Tree Service in Stuart

Martin County is known for strict land rules, but for most single family lots the tree questions in Stuart are about storms, mangroves and HOA approvals.

Stuart has big old live oaks in the neighborhoods near downtown, slash pines in older lots, palms everywhere, and mangroves along the river and lagoon. After past hurricanes, many owners want large trees near the house thinned or taken down. Before any cutting, it helps to know which rules apply to you.

Martin County and City of Stuart rules

For an established single family lot in unincorporated Martin County, the county generally does not regulate tree removal unless the trees are in a preservation area or were required as part of the building permit. That is not true for every situation. HOA common areas need county consent to remove required native trees. Lots with conservation easements or preserve areas are a different story. Inside Stuart city limits, the City of Stuart has its own landscape rules. Florida law also says a local government cannot require a permit to remove a residential tree if you have written documentation from an ISA certified arborist or a Florida licensed landscape architect that the tree is a danger. When in doubt, call the right office before cutting.

Mangroves are different

Mangroves along the St. Lucie River, the Manatee Pocket, Sewall's Point and the lagoon are protected under Florida law. Trimming them usually has to follow state rules on height and method, and removal is tightly limited. If your waterfront has mangroves, ask the tree company whether they know the state mangrove trimming rules, and confirm with the Florida DEP before any work.

Storm prep and debris

Thinning a dense canopy can help a tree let wind pass through instead of acting like a sail. Do that well before hurricane season, since crews get booked fast once a storm is named. Cutting a tree and leaving the debris at the curb outside of the county's collection rules can get you a notice, so ask whether hauling is part of the price.

HOAs and gated communities

Many Stuart HOAs require approval before removing a tree, even on your own lot, and may require a replacement tree from an approved list.

Tree service questions in Stuart

Do I need a permit to remove a tree from my yard in Stuart?

For an established single family lot in unincorporated Martin County, the county generally does not regulate removal unless the tree is in a preservation area or was required by your building permit. Inside Stuart city limits, check with the City of Stuart. HOAs often have their own approval process. If you are unsure, call before cutting, because penalties can be steep.

Can I trim the mangroves behind my house on the St. Lucie River?

Mangroves are protected by Florida law. Limited trimming is often allowed if it follows state rules on height and method, and some trimming needs a professional who qualifies under those rules. Removing mangroves is tightly restricted. Contact the Florida Department of Environmental Protection about your situation before any work, and make sure the tree company knows those rules.

What if an arborist says my tree is dangerous?

Florida law says a local government cannot require a permit or fee to remove a tree on residential property if the owner has written documentation from an ISA certified arborist or a Florida licensed landscape architect that the tree is a danger to people or property. Your HOA rules may still apply. Keep the documentation with your records.

Does my Stuart HOA need to approve tree removal?

Many do, even for trees on your own lot. Some require a replacement tree from an approved list. Ask your property manager or architectural committee first, and get the approval in writing before the crew shows up. Removing a tree without approval can lead to fines or an order to replant.
